Beneficiary Representation
If you are a beneficiary of a trust, we can help you to understand your rights under the trust document. These rights may include:
- The right to receive distributions from the trust;
- The right to an accounting of the transactions of the trust; and
- The right to information about the trust investments.
We can also advise you whether the trustees are properly performing their duties to you, or whether you need to enforce your rights through a court proceeding. At a minimum, we are familiar with the trust language contained in trust agreements and can translate the “legalese” into understandable English.
Many estates do not involve separate counsel and separate interests for trustees, executors and beneficiaries. A large part of our practice consists of the basic work of making sure that creditors are paid, taxes are computed, and assets are distributed or held for beneficiaries according to the terms of the governing document. We advise clients on all aspects of administration of estates, whether in a formal probate court proceeding or in a private trust administration.
